Recently the President has been asked to sign a Bill implementing the result of the recent Referendum on Divorce. The new legislation proposes to reduce the living apart period under the Divorce Act 1996 to a minimum of 2 out of the preceding 3 years. The Bill will also include an updating of the Statutory definition of living apart. The new legislation is also expected to deal with the recognition of Divorces granted in the U.K. in the event of a no deal Brexit. It is clear that the Law has changed in a major way now in respect of Divorce in Ireland and that change is to be most welcome.
