A recent case from Canada illustrates the importance of making your Will and engaging in estate planning well in advance. A Will hastily written on a McDonalds napkin has been formally accepted by a Judge in Canada. Mr. Lanigan wrote the Will while sitting in a McDonalds Restaurant as he thought he was having a heart attack. The matter ended up in Court and the Judge was satisfied as to the validity of the Will. Clearly, this is not something that has ever happened to the best of our knowledge in Irish legal history, however, it does show the importance of making a Will and planning the terms and conditions of your will before it becomes an emergency as it did for the unfortunate Mr. Lanigan.
